Decision: Appeal by the Claimant from a lower court decision which had in turn dismissed the Claimants' application to set aside two procedural rulings in a compensation action before the Expropriation Compensation Board under the Expropriation Act, R.S.B.C. 1996, c. 125. The lower court had declined to hear the application on grounds that the action was out of time. The court allowed the appeal and held that the limitation found in s. 51(2) did not apply.
