Decision: |
Application by two of the Respondents for a stay of proceedings in a judicial review action brought by the Petitioners. Additional applications were brought by the Respondents to have various claims struck out. The main action brought by the Petitioners sought numerous declarations and mandatory injunctions against the two Respondents relating to issues involving access to the Petitioners' land following an expropriation. The Petitioners also had outstanding compensation claims before the Expropriation Compensation Board arising from the same expropriation and that proceeding raised similar issues. The applications for a stay of proceedings was granted in part pending conclusion of the proceedings before the Board and some of the claims were struck out. |
