Decision: |
Application by property owners for leave to appeal a decision of the British Columbia Expropriation Compensation Board. The Appellants had commenced a compensation action following a partial expropriation of land from the Appellants by the Minister of Transportation and Highways pursuant to the Expropriation Act, S.B.C. 1987, c. 23. The Appellants had included the Respondent municipality as a party to the action even though the municipality had not commenced any formal expropriation proceedings. On an application by the municipality, the Board had refused to dismiss the action against the municipality. Although successful the Appellant was not satisfied with the Board's reasons for doing so and sought leave to appeal. The application was dismissed. |
