Application by the Claimants to the Alberta Land Compensation Board for determination of compensation pursuant to the Expropriation Act, R.S.A. 1980, c. E-16. Full taking of a parcel of land in the City of Lethbridge for purposes of a Provincial Court House. The Claimants were lessees pursuant to a lease with four and one-half years left to run at the date of expropriation. The registered owner's claim for compensation was determined earlier in a separate proceeding (Robertson v. Alberta). A separate claim by one of the present Claimants for the expropriation of an adjacent parcel was also considered in a separate proceeding (Minute Muffler v. Alberta). On the present hearing, the Board considered a preliminary issue dealing with the Board's jurisdiction. It was held that the Authority had not expropriated the Claimant's leasehold interest and the application was dismissed. |
