Application to the Ontario Land Compensation Board for an order determining which of the two claimants was entitled to obtain compensation following an expropriation conducted by the Respondent pursuant to the Expropriations Act, R.S.O. 1970, c. 154. The expropriation took place after the Claimant Highland Creek had entered into an agreement for the sale of the subject property to Disposal Services. The Board determined that the claimant Highland Creek had no right to claim compensation and that the claimant Disposal Services had the sole right to claim compensation. The action brought by Highland Creek was dismissed. The Board ordered the Respondent to pay Highland Creek's costs of the application. |
