Appeal and cross-appeal from a compensation award made by a valuator appointed pursuant to the British Columbia Hydro and Power Authority Act, 1964, S.B.C. 1964, c. 7. The award resulted from the expropriation of the Claimant's property located at Renata. The land was taken to permit flooding of the Arrow Lakes that would occur following construction of a dam on the Columbia River. The valuator had awarded compensation in the amount of $34,485.61. On this appeal the award was reduced to $30,662.00 together with statutory interest. Costs were awarded to the Authority at 100% of tariff costs for the main appeal. Costs were awarded to the Claimant at 25% of tariff costs for the cross appeal. |
