Application by the Claimant to the British Columbia Expropriation Compensation Board for determination of compensation pursuant to the Expropriation Act, S.B.C. 1987, c. 23. The Claimant owned a parcel of land located in Chilliwack. The Authority constructed a highway overpass adjacent to and abutting the subject property but no land was taken from the Claimant. The Claimant alleged that the overpass had destroyed the property's amenities and eliminated direct access to an arterial street thereby diminishing the value of the subject property. The Board held that the Claimant had not proven any loss in market value. The claim was dismissed and each party was found to be responsible for its own costs. |
