Application by the Claimant for determination of compensation by the British Columbia Expropriation Compensation Board pursuant to the Expropriation Act, S.B.C. 1987, c. 23. The Respondent had constructed an overpass on a street that was adjacent to the Claimant's property on which an automotive brake and muffler repair shop was operated. No land was taken. However, the overpass interfered with access to the subject property. An award of compensation was made for the reduction in market value of the subject property. |
