Appeal by a property owner from an award of compensation made by the Exchequer Court pursuant to the Expropriation Act, R.S.C. 1927, c. 64. The subject property was located in Hull, Quebec and was used by the Appellant for the clothing and canvas division of its manufacturing business. The Respondent carried out two expropriations of the Appellant's property. At trial the Appellant was awarded $45,800 for the first expropriation and $350,000 for the second. The appeal was allowed and the compensation awards were increased to $48,880 and $450,000 respectively. Interest was allowed on one of the awards only. Costs were also awarded. |
