Application to the Ontario Land Compensation Board for determination of compensation payable to the Claimants following the expropriation of an electric transmission line easement pursuant to the Expropriations Act, R.S.O, 1980, c. 148. At the date of expropriation the subject property was being used for a landfill and sewage disposal business. The subject property was located in eastern Ontario near Napanee. The parties had previously agreed that the market value of the easement rights taken was $18,500. The Board awarded $62,000 for mitigation costs and $35,000 for business loss which was rounded to $100,000, plus interest and costs. |
