This article was contributed by Stephen F. Waqué, a Toronto lawyer and partner with the firm Borden Ladner Gervais. Mr. Waqué is a co-author of the widely used text titled New Law of Expropriation, published by Carswell.

This article was originally presented to the 2003 Fall Conference of the British Columbia Expropriation Association. It was subsequently revised and retitled. In the article, Mr. Waqué discusses the implications of the "ignoring the scheme" provisions of the Ontario and British Columbia expropriation statutes. It is reproduced here with the permission of the author.
