Introduction

This article was contributed by Alan Macek, a law student at the University of Toronto. It was originally written in March 2003 to satisfy a Property Law course requirement for the J.D. program. The paper attempts to describe the current state of the law on regulatory expropriation and then goes on to question whether the law has made an appropriate balance between individual property rights and the public interest.
